Terms and Conditions

1. Definitions
In these Terms and Conditions:
- "Service" means the ResiQuote website located at https://resiquote.vercel.app and all associated features, tools, APIs, and content.
- "User", "you", or "your" means any person who accesses or uses the Service.
- "We", "us", or "our" means ResiQuote and its operators.
- "Estimate" or "Quote" means any cost figure, range, breakdown, or projection generated by the Service, whether produced by AI, algorithmic calculation, or any combination thereof.
- "Builder" means any tradesperson, contractor, or construction company registered on or matched through the Service.
- "Content" means all text, images, data, estimates, reports, and other material available through the Service.
2. Acceptance of Terms
By accessing or using any part of the Service, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms and Conditions in full. If you do not agree with any part of these terms, you must not use the Service.
These Terms and Conditions apply to all Users, including those who browse without registering, registered account holders, and builders or trade professionals using the platform.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
3. Nature of the Service — Estimates Are Not Formal Quotes
Specifically, you acknowledge and agree that:
- Estimates are indicative ranges only. Actual costs for any given project will vary depending on site conditions, ground conditions, structural factors, access, existing construction quality, material prices, contractor availability, and many other variables that cannot be assessed remotely.
- An Estimate generated by the Service is not equivalent to, and cannot substitute for, a formal written quotation from a qualified and registered contractor who has physically inspected the property and scope of works.
- Estimates do not account for unforeseen works, hidden defects, latent issues, or site-specific complications that may only be discovered during construction or upon detailed survey.
- Estimates do not include the cost of statutory approvals, planning fees, building regulations applications, architect fees, structural engineer reports, party wall agreements, or other professional and legal fees unless explicitly stated.
- Construction and repair costs are subject to market fluctuations, material shortages, labour availability, and inflation. Any Estimate provided reflects conditions at the approximate time of generation and may become outdated rapidly.
- The confidence score displayed alongside an Estimate is an internal metric reflecting the AI model's assessment of data quality only. It is not a guarantee of accuracy and should not be interpreted as such.
- Repair estimates in particular carry inherent uncertainty because they are based on user-provided descriptions and photographs alone. The true extent and cost of repair work can only be determined by a qualified professional inspecting the property in person.
You use any Estimate entirely at your own risk. We strongly recommend that you obtain a minimum of three written quotations from suitably qualified and insured contractors before committing to any expenditure.
4. No Professional Advice
Nothing on the Service constitutes architectural, structural, engineering, legal, financial, planning, or any other form of professional advice. The Service is an information tool only.
Before commencing any construction, extension, or repair project, you should consult appropriately qualified professionals including but not limited to:
- A RIBA-registered architect or architectural technologist
- A chartered structural engineer (MIStructE or CEng)
- Your local authority planning department
- Building control (local authority or approved inspector)
- A solicitor regarding party wall matters
- A qualified and registered tradesperson for any specialist works (Gas Safe for gas, NICEIC or NAPIT for electrical, etc.)
ResiQuote accepts no liability for any decision made in reliance upon information or Estimates provided by the Service without appropriate professional verification.
5. User Accounts and Registration
To access certain features of the Service, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration and keep it updated.
- Maintain the confidentiality of your password and account credentials.
- Accept responsibility for all activity that occurs under your account, whether or not authorised by you.
- Notify us immediately of any suspected unauthorised access to your account at security@resiquote.co.uk.
- Not share your account with any other person or allow others to access the Service using your credentials.
We reserve the right to suspend or terminate any account at our sole discretion, including where we suspect misuse, fraud, or breach of these Terms.
6. Acceptable Use
You agree not to use the Service to:
- Submit false, misleading, or fraudulent information, including inaccurate descriptions or photographs that do not represent the property or works described.
- Scrape, crawl, or systematically extract data from the Service using automated tools, bots, or scripts without our prior written consent.
- Reverse engineer, decompile, or attempt to extract the source code, AI models, pricing algorithms, or proprietary data underlying the Service.
- Reproduce or republish Estimates or other Content for commercial purposes without our prior written permission.
- Use the Service in any way that infringes the intellectual property rights of ResiQuote or any third party.
- Introduce viruses, malware, or other harmful code into the Service.
- Use the Service in connection with any unlawful activity, including money laundering, fraud, or obtaining quotes to support fraudulent insurance claims.
- Harass, threaten, or abuse other users, builders, or our staff through any communication features of the Service.
7. AI-Generated Content — Specific Disclaimers
The Service uses large language models and machine learning algorithms to generate cost estimates. You specifically acknowledge that:
- AI models can produce inaccurate, incomplete, or contextually inappropriate outputs. Such outputs are commonly referred to as "hallucinations" in the industry. We cannot guarantee that any AI-generated content is free from such errors.
- AI models are trained on historical data and may not reflect current market conditions, recent material price changes, or contemporary construction practices.
- The AI does not have the ability to inspect properties, review planning histories, assess structural conditions, or take into account site-specific factors.
- Outputs may differ materially between uses of the Service even for substantially identical inputs, due to the probabilistic nature of AI models.
- Where the AI model is unavailable, the Service automatically falls back to a deterministic calculation engine. Such "fallback" estimates are clearly labelled and carry reduced confidence.
ResiQuote takes reasonable steps to calibrate and quality-check AI outputs, but this does not constitute a warranty of accuracy.
8. Builder and Contractor Listings
The Service may in future facilitate introductions between homeowners and builders or contractors. Where this feature is available:
- ResiQuote is not a party to any contract entered into between a homeowner and a builder. Any such contract is solely between you and the relevant contractor.
- We do not guarantee the quality, competence, licensure, insurance status, or financial standing of any builder listed or matched through the Service. Verification status displayed on the platform reflects checks carried out at the time of onboarding and may not reflect the builder's current status.
- You are solely responsible for conducting your own due diligence before engaging any contractor, including verifying insurance, qualifications, Companies House status, and checking references.
- ResiQuote accepts no liability for any loss, damage, injury, delay, or defective work arising from any works carried out by a builder introduced through the Service.
- Any dispute between a homeowner and a builder is a matter solely between those parties. We may, at our sole discretion, provide dispute resolution assistance, but we are not obliged to do so.
9. Intellectual Property
All intellectual property rights in the Service, including the website design, software, AI models, pricing algorithms, cost data, branding, and content produced by ResiQuote, are owned by or licensed to us. Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use the Service for its intended purpose.
You retain ownership of any content you submit to the Service, including photographs and project descriptions. By submitting such content, you grant us a non-exclusive, royalty-free, worldwide licence to use, store, process, and analyse that content for the purpose of providing and improving the Service.
You warrant that any content you submit does not infringe the rights of any third party, is not defamatory, and complies with all applicable laws.
10. Limitation of Liability
To the fullest extent permitted by applicable law:
- ResiQuote provides the Service on an "as is" and "as available" basis without any warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- We shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the Service, including but not limited to: financial loss arising from reliance on an Estimate; costs of over- or under-specification of works; delays to your project; defective workmanship by any contractor; loss of profit; loss of business; loss of data; or any other economic loss.
- Where liability cannot be excluded by law, our total aggregate liability to you in connection with the Service shall not exceed the greater of (a) the total amount paid by you to us in the twelve months preceding the claim, or (b) £100 (one hundred pounds sterling).
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
11. Indemnification
You agree to indemnify, defend, and hold harmless ResiQuote and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of or access to the Service.
- Your breach of these Terms and Conditions.
- Any content you submit to the Service that infringes any third party's intellectual property rights or is otherwise unlawful.
- Any contract or dispute between you and a builder or contractor introduced through the Service.
12. Pricing, Payments, and Subscriptions
Certain features of the Service may be available on a paid basis. Where applicable:
- All prices are displayed in pounds sterling (GBP) and are inclusive of VAT unless otherwise stated.
- Payments are processed by Stripe, a third-party payment processor. Your payment details are not stored by ResiQuote. By making a payment, you also agree to Stripe's terms of service.
- Subscriptions are billed on a recurring basis (monthly or annually as selected). You authorise us to charge your payment method on each renewal date.
- You may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods unless required by law.
- We reserve the right to change our pricing at any time. We will give at least 30 days' notice of any price increase affecting existing subscribers.
13. Data Protection and Privacy
Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms and Conditions. By using the Service, you consent to the processing of your personal data as described therein.
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
14. Third-Party Links and Services
The Service may contain links to third-party websites or integrate with third-party services. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.
Your use of third-party services accessed through or in connection with the Service (including Supabase, Stripe, and any AI model providers) is subject to those third parties' own terms and conditions.
15. Availability and Service Changes
We do not guarantee that the Service will always be available or uninterrupted. We may suspend, withdraw, discontinue, or change any part of the Service at any time without notice. We will not be liable to you if, for any reason, the Service is unavailable at any time or for any period.
We reserve the right to modify, update, or discontinue the Service (or any part thereof) at any time. Where practicable, we will provide reasonable notice of material changes.
16. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if we reasonably believe you have breached these Terms.
You may terminate your account at any time by contacting us at support@resiquote.co.uk. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall do so, including but not limited to Sections 9, 10, 11, and 17.
17. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), shall be governed by and construed in accordance with the law of England and Wales.
You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.
If you are a consumer based in another part of the United Kingdom (Scotland or Northern Ireland), you may also have the right to bring proceedings in your local courts.
18. Consumer Rights
If you are a consumer, nothing in these Terms affects your statutory rights under English law, including rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and any other applicable consumer protection legislation.
For the avoidance of doubt, our free-to-use cost estimation service does not constitute a "distance contract" for goods or services within the meaning of those Regulations, as no goods or services are supplied to you in exchange for your Estimate. However, paid subscription services and paid report products are subject to applicable consumer cancellation rights.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ResiQuote with respect to the Service and supersede all prior agreements, representations, and understandings.
No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.
